TOP LEVEL DOMAIN (TLD) ACCEPTABLE USE AND LICENSE POLICY

This Top Level Domain (TLD) Acceptable Use and License Policy (“Policy”) governs the registration, use, and operation of domain names within Fanz-controlled top-level domains, including but not limited to .fanz and related TLD extensions (“Licensed TLDs”). By registering or using any domain name within our Licensed TLDs, you (“Licensee”) agree to be bound by this Policy.
Fanz hereby grants Licensee a limited, non-exclusive, non-transferable license to use a domain name within our Licensed TLDs, subject to the terms and conditions set forth in this Policy. This license does not grant any ownership rights in the TLD itself or any intellectual property rights beyond the limited use described herein.
3.1 General Requirements
Licensee must:
- •Use the licensed domain name in good faith and in compliance with all applicable laws
- •Maintain accurate and current registration information
- •Respond promptly to legitimate inquiries regarding domain name usage
- •Comply with all applicable internet standards and protocols
3.2 Content Standards
Domain names and associated content must:
- •Be suitable for general audiences and family-friendly when possible
- •Comply with applicable advertising standards and truth-in-advertising laws
- •Respect intellectual property rights of third parties
- •Maintain professional standards consistent with sports and social media industries
The following uses of Licensed TLDs are strictly prohibited:
4.1 Illegal Activities
- •Any illegal activity under applicable local, state, federal, or international law
- •Fraud, phishing, or deceptive practices
- •Money laundering or financial crimes
- •Distribution of malware, viruses, or harmful code
4.2 Harmful Content
- •Harassment, bullying, or threats against individuals or groups
- •Hate speech or discriminatory content based on race, religion, gender, sexual orientation, or other protected characteristics
- •Adult content, pornography, or sexually explicit material
- •Violence, graphic content, or content promoting self-harm
4.3 Trademark and IP Violations
- •Infringement of third-party trademarks, copyrights, or other intellectual property rights
- •Cybersquatting or domain name speculation in bad faith
- •Use of domain names that mislead consumers about brand affiliation
4.4 Technical Misuse
- •Spamming, mass unsolicited communications, or bulk email distribution
- •Network abuse, including denial-of-service attacks or system intrusion attempts
- •Domain parking solely for revenue generation without legitimate use
Given our focus on sports and social media:
5.1 Sports-Related Requirements
- •Content must maintain integrity and respect for sports, athletes, and sporting events
- •Compliance with applicable sports governing body rules and regulations
- •No promotion of gambling or betting where prohibited by law
- •Respect for team names, league trademarks, and official sports designations
5.2 Social Media Standards
- •Adherence to major social media platform community guidelines
- •Respect for user privacy and data protection requirements
- •Implementation of appropriate age verification where required
- •Moderation of user-generated content to maintain community standards
6.1 Monitoring Rights
Fanz reserves the right to monitor domain name usage and investigate potential violations of this Policy. This includes technical monitoring, content review, and response to third-party complaints.
6.2 Violation Response
Upon discovery of Policy violations, Fanz may:
- •Issue warnings or notices of violation
- •Require corrective action within specified timeframes
- •Suspend domain name services
- •Terminate the domain name license
- •Transfer domain name to appropriate authorities where required by law
7.1 Internal Disputes
Licensees may appeal enforcement actions through Fanz’s internal dispute resolution process by submitting written appeals within thirty (30) days of enforcement action.
7.2 Third-Party Disputes
Domain name disputes involving third parties shall be resolved through:
- •UDRP (Uniform Domain-Name Dispute-Resolution Policy) procedures
- •URS (Uniform Rapid Suspension) system where applicable
- •Applicable court proceedings
Licensees must comply with applicable data protection and privacy laws, including:
- •Implementation of appropriate privacy policies
- •Secure handling of personal information
- •Compliance with GDPR, CCPA, and other applicable privacy regulations
- •Cooperation with lawful data requests
9.1 Termination by Fanz
Fanz may terminate domain name licenses immediately for:
- •Material breach of this Policy
- •Illegal use of licensed domain names
- •Failure to pay applicable fees or charges
- •Court orders or legal requirements
9.2 Effect of Termination
Upon termination:
- •All rights to use the domain name cease immediately
- •Associated services may be discontinued
- •Domain name may be transferred, suspended, or deleted
- •Licensee remains liable for any accrued obligations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO DOMAIN NAME USAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Licensee agrees to indemnify, defend, and hold harmless Fanz from any claims, damages, losses, or expenses arising from Licensee’s use of Licensed TLDs or violation of this Policy.
Fanz reserves the right to modify this Policy at any time. Modifications become effective upon posting to our website. Continued use of Licensed TLDs constitutes acceptance of modified terms.
This Policy shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
